A Plea for a Teleological Extension of § 937 BGB«: If the vindication claim is no longer enforceable, ownership and possession fall apart permanently. This unfortunate legal situation can be caused, among other things, by the statute of limitations of the vindication claim, the sending of unsolicited goods and the claiming of damages instead of the vindication claim. The author examines the solutions considered so far and also introduces the teleological extension of § 937 of the Civil Code into the discussion.
